By downloading, installing, or using Upliftr ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.
We reserve the right to modify these Terms at any time. Continued use of the App after changes constitutes acceptance of the modified Terms.
2. Description of Service
Upliftr is a mobile application designed to support individuals in their personal recovery journey. The App provides:
- Streak and progress tracking
- Daily check-in functionality
- Mood logging and tracking
- AI-powered supportive conversation (Miles)
- Community forum and chat features
- Breathing exercises and panic button support
3. Not Medical Advice
IMPORTANT: Upliftr is a support tool only. It is NOT a substitute for professional medical advice, diagnosis, or treatment. The App, including our AI companion Miles, does not provide medical, psychological, or therapeutic advice.
If you are experiencing a mental health crisis, please contact emergency services or a crisis hotline immediately. If you are struggling with addiction, please seek help from qualified healthcare professionals.
Never disregard professional medical advice or delay seeking it because of something you have read or experienced in this App.
4. Eligibility
You must be at least 17 years old to use Upliftr. By using the App, you represent that you are at least 17 years of age and have the legal capacity to enter into these Terms.
5. Account Responsibilities
You are responsible for:
- Maintaining the security of your account and device
- All activities that occur under your account
- Ensuring the accuracy of information you provide
- Notifying us immediately of any unauthorized use of your account
6. User Conduct
When using Upliftr, especially community features, you agree NOT to:
- Post content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
- Share sexually explicit, violent, or graphic content
- Harass, bully, or intimidate other users
- Impersonate others or misrepresent your identity
- Share personal information of others without consent
- Spam, advertise, or promote products/services
- Attempt to hack, disrupt, or exploit the App
- Violate any applicable laws or regulations
- Encourage or promote harmful behaviors
We reserve the right to remove content and suspend or terminate accounts that violate these rules.
7. Community Guidelines
Our community is built on mutual support. Please:
- Be respectful and supportive of others
- Share experiences constructively
- Respect others' privacy
- Report inappropriate content or behavior
- Remember that everyone is on their own journey
8. Intellectual Property
All content, features, and functionality of the App (including but not limited to text, graphics, logos, icons, and software) are owned by Upliftr and are protected by copyright, trademark, and other intellectual property laws.
You retain ownership of content you create and share (posts, comments, etc.), but grant us a non-exclusive, worldwide, royalty-free license to use, display, and distribute that content within the App.
9. AI Companion (Miles)
Miles is an AI-powered feature designed to provide supportive conversation. By using Miles, you acknowledge that:
- Miles is not a real person, therapist, or medical professional
- Responses are generated by AI and may not always be accurate or appropriate
- Miles should not be relied upon for medical, legal, or professional advice
- Conversations may be processed by third-party AI services (see Privacy Policy)
- Usage is subject to credit limits based on your subscription tier
10. Subscriptions and Payments
Some features may require a paid subscription. If you purchase a subscription:
- Payment will be charged to your Apple ID account at confirmation of purchase
- Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period
- You can manage and cancel subscriptions in your Apple ID account settings
- No refunds will be provided for partial subscription periods
11. Account Termination
You may delete your account at any time through the App's settings. We may suspend or terminate your account if you violate these Terms, engage in prohibited conduct, or for any other reason at our discretion.
Upon termination, your right to use the App ceases immediately. We may retain certain data as required by law or for legitimate business purposes.
12. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
WE MAKE NO WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY CONTENT, INCLUDING AI-GENERATED RESPONSES.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, UPLIFTR AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP.
IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.
14. Indemnification
You agree to indemnify and hold harmless Upliftr, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the App or violation of these Terms.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
16. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
